Terms of Service for MYViki

Effective Date: 1 October 2025

Welcome to the MYViki service provided by Malaysian Chinese VTuber Hub (referred to as "the Platform" or "We"). Before using this service, please carefully read these Terms of Service (the "Terms"). By using the Service, you agree to and accept all provisions of these Terms.

1. Service Overview

The Platform operates as a non-profit service, primarily offering the following functions:

  • Content Aggregation: Aggregating VTuber-related content from third-party sources (such as YouTube).
  • Data Analytics: Providing statistical and analytical data related to VTuber performance.
  • Live Stream Link Aggregation: Centralizing and showcasing VTuber live stream links and schedules.

2. Compliance with YouTube Terms

Given that this Platform integrates YouTube data and content, and in accordance with the YouTube API Developer Policies, by using this Service, you explicitly agree to be bound by the YouTube Terms of Service.

In the event of any conflict between these Terms and the YouTube Terms of Service, the YouTube Terms of Service shall prevail with respect to the use of YouTube API Services.

3. Users and Access

  • Target Users: The Service is primarily aimed at Malaysian Chinese VTubers and users interested in their content.
  • No Registration/Age Restriction: Accessing and using the Service does not require account registration, and the Platform does not set an age restriction. However, minor users accessing and using this Service should do so under the guidance of a parent or legal guardian.

4. Intellectual Property

4.1 Platform Intellectual Property

  • All trademarks, logos, designs, service marks, and all original or exclusively created content, data analysis models, and code (excluding aggregated third-party content) belong to the Platform. You may not copy, modify, publish, or use them in any way without our express written permission.

4.2 User-Submitted Content

  • The ownership and intellectual property rights of any content uploaded, submitted, or provided by users (if the Platform offers this function) remain with the user.
  • For the purpose of operating and promoting the Platform, you hereby grant the Platform a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, reproduce, distribute, display, and modify your content.

5. Disclaimers

You understand and agree that the Service is provided on an "as is" and "as available" basis. The Platform expressly disclaims all warranties and guarantees of any kind to the fullest extent permitted by law. Specifically:

  • Non-Profit and Sustainability
  • As this is a non-profit service, we cannot guarantee the sustainability or perpetual operation of the Service. We reserve the right to modify, suspend, or terminate the Service at any time without prior notice.
  • Third-Party Content
  • The link and content aggregation functions involve numerous third-party contents and external websites. We are not responsible for the content, accuracy, completeness, or legality of any linked third-party materials. Any risks and liabilities arising from your use of third-party links are borne solely by you.
  • Data Accuracy
  • The data provided by this Platform may have synchronization delays and may not be real-time. We cannot offer any guarantee or promise regarding the accuracy, completeness, or timeliness of the data. You should not use this data for any commercial decision-making that requires high precision or real-time information.

6. Limitation of Liability

To the extent permitted by applicable law, the Platform shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages, including but not limited to loss of data, loss of profits, or business interruption, arising from your use of or inability to use the Service, even if the Platform has been advised of the possibility of such damages.

7. Termination and Suspension

  • Right of Termination: If we reasonably believe that your access is causing issues, harm, or legal risks to the Platform's operation, security, other users, or third parties, we reserve the right to immediately suspend or terminate your access and use of the Service without prior notice.
  • Survival: Provisions regarding Intellectual Property, Disclaimers, Limitation of Liability, Termination, and Governing Law shall survive any termination of the Service.

8. General Provisions

  • Governing Law: The interpretation, validity, and enforcement of these Terms shall be governed by the laws of Malaysia, without regard to its conflict of law principles. Any dispute arising out of or in connection with these Terms or the Service shall be submitted to the courts of Malaysia for resolution.
  • Entire Agreement: These Terms constitute the entire agreement between you and the Platform regarding the use of the Service.
  • Modifications: We reserve the right to modify these Terms at any time. Modified Terms will be posted on the Platform and will take effect automatically. Your continued use of the Service after the Terms have been modified constitutes your acceptance of the revised Terms.
